GoTell Campaign Creation Terms & Conditions

These terms govern the creation, publication, and distribution of campaigns through the GoTell platform. Please read them carefully before publishing a campaign.

1. Merchant Responsibility

The merchant is solely responsible for all campaigns created, published, and distributed through GoTell.

By publishing a campaign, the merchant represents and warrants that:

  • The campaign is truthful and accurate.
  • The merchant has the authority to offer all promotions, rewards, discounts, products, services, or experiences described.
  • The merchant will honor all valid campaign claims and redemptions in accordance with the published campaign terms.
  • The campaign complies with all applicable federal, state, and local laws and regulations.

2. Campaign Content

Merchants may not create campaigns that:

  • Contain false or misleading information.
  • Promote illegal products or services.
  • Discriminate against protected classes.
  • Infringe upon trademarks, copyrights, or other intellectual property rights.
  • Contain offensive, abusive, or fraudulent content.
  • Misrepresent pricing or availability.

GoTell reserves the right to remove or suspend any campaign that violates these standards.

3. Campaign Parameters

Merchants are responsible for configuring campaign parameters, including but not limited to:

  • Start and end dates
  • Quantity limits
  • Redemption limits
  • Eligibility requirements
  • Referral rewards
  • Expiration dates
  • Geographic restrictions

Once published, consumers may rely on these parameters.

Merchants should avoid making material changes after a campaign has begun.

4. Required Call-To-Action (CTA)

Every GoTell campaign must include a measurable Call-To-Action.

Examples include:

  • Claim Offer
  • Reserve Table
  • Book Appointment
  • RSVP
  • Join Waitlist
  • Claim Gift

Campaigns without a measurable CTA cannot be published.

5. Campaign Fulfillment

GoTell provides campaign creation, distribution, tracking, attribution, and referral functionality.

The merchant remains solely responsible for:

  • Fulfilling reservations
  • Honoring promotions
  • Providing products and services
  • Managing appointments
  • Customer service
  • Refunds
  • Resolving disputes with customers

GoTell is not responsible for the merchant's fulfillment of any campaign.

6. Customer Data

GoTell may collect customer information necessary to facilitate campaign participation.

Merchants agree to use customer information only for legitimate business purposes and in compliance with applicable privacy laws.

Merchants may not sell or improperly share customer information obtained through GoTell.

7. Referral Rewards

If a merchant enables referral rewards:

  • The merchant determines the reward.
  • The merchant determines reward eligibility.
  • Rewards will only be issued according to the campaign rules established by the merchant.
  • GoTell may withhold rewards in cases of suspected fraud or abuse.

8. Fraud Prevention

GoTell may monitor campaigns for:

  • Duplicate claims
  • Self-referrals
  • Fake accounts
  • Automated activity
  • Referral abuse
  • Suspicious redemption patterns

GoTell may suspend campaigns or accounts while investigating suspicious activity.

9. Fees

Merchants agree to pay all applicable GoTell fees, including subscription fees, campaign fees, and any applicable per-action fees.

Fees are earned upon completion of the applicable measurable campaign action as defined by GoTell.

All fees are non-refundable unless otherwise required by law.

10. Campaign Suspension

GoTell reserves the right to pause, remove, or reject campaigns that:

  • Violate these Terms
  • Harm consumers
  • Mislead users
  • Present legal or reputational risk to the platform
  • Generate excessive fraudulent activity

11. Intellectual Property

Merchants retain ownership of their campaign content.

By publishing a campaign, merchants grant GoTell a non-exclusive, worldwide license to display, distribute, and promote campaign content for the purpose of operating and marketing the GoTell platform.

12. Limitation of Liability

GoTell acts solely as a technology platform connecting merchants and consumers.

GoTell does not guarantee:

  • Campaign performance
  • Customer traffic
  • Revenue
  • Reservations
  • Sales
  • Appointment bookings

Merchants acknowledge that campaign success depends on numerous factors outside GoTell's control.

13. Platform Improvements

GoTell may modify campaign functionality, templates, analytics, referral systems, and platform features at any time to improve the service.

14. Acceptance

By publishing a campaign through GoTell, the merchant acknowledges that they have read, understood, and agree to these Campaign Creation Terms & Conditions.
